1. Agreement and eligibility
These Terms of Service (“Terms”) form an agreement between you and Amadeus Worldwide (“AW,” “we,” “us” or “our”). By submitting a journey request, using checkout or purchasing a service, you agree to these Terms and acknowledge our Privacy Policy.
You must be at least 18 years old and legally capable of entering a contract. When you submit information or book for another traveler, you represent that you are authorised to act for that traveler and provide their information.
2. What AW Stopover provides
AW Stopover is designed to identify intentional extended connections and coordinate a flight itinerary with hotel, transfer, activity and concierge options. Depending on the service offered at the time, AW may act as a travel adviser, disclosed agent, arranger, reseller or package organiser. The checkout and confirmation will identify the applicable supplier and commercial structure.
The current proof of concept can save leads and consent records, search Duffel flight inventory, present illustrative local packages and create either a simulated order or an enabled Duffel test or card order. Unless expressly confirmed, illustrative hotels, transfers, activities and concierge items are not reserved.
3. Quotes, availability and accuracy
Flight offers, fares, taxes, exchange rates, supplier inventory and conditions can change until a booking is confirmed. An offer may expire, be withdrawn, be repriced or become unavailable. We may refresh an offer and ask you to approve an updated price or itinerary before booking.
Descriptions, photographs, travel times, usable stopover hours and local-package prices may be estimates. We make reasonable efforts to present information accurately, but supplier content and schedules are controlled by third parties.
4. Booking, payment and confirmation
A booking is not complete merely because you submit a lead, select an option or enter payment information. A booking is confirmed only when the relevant supplier accepts it and a booking reference or other confirmation is issued.
Duffel flight payment
When Duffel Cards is enabled, the customer’s card may be authenticated and used to pay the airline or accommodation provider through Duffel. Card information is collected by Duffel-hosted fields. AW’s server receives the booking and authentication identifiers needed to create the order, not the full card number.
Separate local-package payment
Unless checkout expressly states otherwise, a Duffel card charge covers the selected flight supplier amount only. Hotels, transfers, activities, insurance, concierge services and AW fees may require a separate payment method, invoice or merchant checkout. The payment summary will disclose what is included in each charge.
Authorisation
You authorise the disclosed supplier or merchant to charge the approved amount and represent that you are authorised to use the payment method. You are responsible for bank, currency-conversion, card, tax or other charges imposed by your provider.
AW may decline, pause or manually review a booking for suspected fraud, supplier restrictions, pricing errors, legal obligations or operational risk.
5. Independent travel suppliers
Airlines, hotels, ground-transport operators, activity providers and other travel suppliers are independent entities. Their fare rules, contracts of carriage, check-in requirements, cancellation terms, liability limits and privacy notices also apply. Where AW acts only as agent or arranger, the supplier is responsible for delivering its service.
Operating carriers may differ from marketing carriers. The booking confirmation should identify the operating carrier for each segment. You must review the final itinerary and immediately report errors.
6. Traveler responsibilities
You are responsible for:
- providing complete and accurate traveler names, contact information, dates of birth and other required details;
- checking passports, visas, transit or entry permission, vaccinations, customs rules, travel advisories and destination requirements;
- confirming whether baggage must be collected and rechecked during a stopover;
- arriving at airports and meeting points with sufficient time and following supplier instructions;
- reviewing fare, change, cancellation and refund conditions before authorising the booking;
- maintaining suitable travel insurance and emergency funds where appropriate.
AW may provide information or planning assistance but does not guarantee admission to a country, visa approval, minimum connection acceptance, baggage through-checking or protection from disruption unless a written product specifically states otherwise.
7. Stopover timing and disruption
“Usable city time” is an estimate that may deduct immigration, baggage, transfers, rest, check-in, security and contingency buffers. Actual conditions vary. You must follow the final return-to-airport time and supplier instructions.
Flight delays, schedule changes, weather, border delays, traffic, strikes or supplier failures may reduce or eliminate the planned experience. AW may assist with changes where included in the service, but assistance does not create an insurance policy or missed-flight guarantee.
8. Changes, cancellations and refunds
Changes and cancellations are subject to the fare and supplier rules shown before booking or provided in confirmation. Fees may include supplier charges, fare differences, non-refundable components and a disclosed AW service fee. Some items may be entirely non-refundable.
Refund timing depends on supplier approval, payment networks and the original payment method. AW may not issue funds it has not received from a supplier. Where components are contracted separately, cancellation of one component does not automatically cancel the others.
9. Marketing choices
Consent to AW email offers and consent to sharing with selected marketing partners are optional, separate from these Terms and not required to complete a travel request. Choices can be changed through Privacy Choices. Essential service communications may still be sent about an active request or booking.
10. Acceptable use
You may not misuse the service, submit false information, interfere with security, scrape or resell content without permission, attempt unauthorised access, use stolen payment methods, or use the service for illegal, fraudulent or abusive activity. We may suspend access and preserve information for investigation.
11. Intellectual property
AW names, logos, designs, software, content and compilations are owned by or licensed to Amadeus Worldwide and protected by applicable law. Supplier names and marks belong to their owners. These Terms do not grant a licence except the limited right to use the service for its intended personal or authorised business purpose.
12. Disclaimers
To the maximum extent permitted by law, the proof of concept and any unconfirmed or illustrative inventory are provided “as is” and “as available.” AW does not warrant uninterrupted access, error-free data, continued availability or that a proposed stopover will meet every personal preference.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, AW will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, opportunity, enjoyment or data; or acts, omissions, insolvency or failures of independent suppliers, except where liability cannot be limited by law.
Any monetary cap, supplier-agent allocation and package-travel liability language must be finalised for the production sales model and jurisdiction before launch. The proof of concept does not create a confirmed travel contract or payment unless the screen expressly states that a supplier order was created.
14. Your responsibility for misuse
To the extent permitted by law, you agree to be responsible for losses and reasonable costs resulting from your fraud, unauthorised payment use, material breach of these Terms or intentional misuse of the service.
15. Governing law and disputes
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Courts with jurisdiction in New Jersey will have exclusive jurisdiction, subject to any non-waivable right to bring a claim elsewhere.
Before filing a formal claim, please contact us and provide a reasonable opportunity to resolve the matter. Any arbitration, class-action waiver or specific venue provision should be added only after legal review and conspicuous consumer disclosure.
16. General terms
If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. We may assign these Terms as part of a business transfer; you may not assign them without our consent. Supplier terms and any booking-specific written conditions are incorporated where disclosed.
We may update these Terms. The version accepted for a request or booking is recorded with a timestamp. Material changes apply prospectively unless law requires otherwise.
